In a development with far-reaching constitutional implications, the Supreme Court has indicated that it may constitute a Special Investigation Team (SIT) to independently investigate the violence that erupted during recent student protests. The matter was heard by a Bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi, and Justice V. Mohana, which was dealing with a batch of petitions alleging police excesses, unlawful use of force, and injuries sustained by both protesters and law enforcement personnel.
Recognising the seriousness of the allegations from all sides, the Court observed that the truth must be established through an impartial and evidence-driven investigation rather than competing narratives. To ensure that no crucial material is lost or tampered with, the Bench issued interim directions directing the authorities to preserve all CCTV footage, video recordings, official duty logs, and other relevant records connected with the incidents.
The Court’s indication that an independent Special Investigation Team (SIT) may be constituted reflects its commitment to ensuring transparency and public confidence in the investigative process. Unlike routine police inquiries, an SIT is generally entrusted with conducting a neutral investigation in cases involving allegations against public authorities or matters of exceptional public importance.
